With the new sync applications feature in iTunes 9, can Apple figure out my winterboard theme = a jailbreak? Also, I'm still on firmware 3.0.1 and I don't plan on updating...so will itunes still allow me to decline an update?

Categories & Five Icon Dock don't play well with iTunes app setup.
 
Well the app arranging screen in itunes comes with 3.1, so you won't have it with 3.0.1, if that's what you mean.

As I re-read the OP, I missed the mark.

You can always decline an update. Don't select update, don't select Download & Install. Worst case scenario, pull the USB plug out of the iPhone during the 4 or 5 minutes it takes the 3.1 firmware to download.

iTunes 9 should have no issues syncing with your 3.0.1 firmware.
