Since no contract needs to be signed when purchased, will it be really easy for people to put these on ebay?

There is nothing stopping you from walking into an AT&T/Apple Store and purchasing one of these phones, regardless of your relationship with AT&T. However, whomever wants to end up using the phone must sign up for a contract with AT&T before they can do so.
