my own fault obviously, it just didn’t cross my mind until I was fitting it to the watch.
I know Apple has a great returns policy, would they cover my stupidity?
If not the band seems secure are there any issues using the 38mm band?

It Depends how long you have owned the Apple Watch band for. If you're slightly out of your return period, They might make an exception for an exchange. But I would not continue using a 38 mm band for a 42 mm band port, being there are uncertainties.

Ok cool. I will go tomorrow and do it, I wasn’t sure what reasons you could return an item for as I have never done it before.

All changed with no issues at all.
Apple amaze me sometimes, I had opened the packaging and I would fully expect a company to say it’s my fault and not exchange it, I wouldn’t have had any bad feelings about it either.

I don't know of any company that would be in business right now if they didn't swap that out for you. Things like this happen. I return things to various retailers all the time, even after opening the package.
