When i start a handbrake video encode, the cpu that's mostly idle doing music/web/chat work goes from 55C-ish up to 101C then the fans FINALLY kick up from 2000rpm but as it slowly climbs, the cpu keeps going up to 105 then it starts going down.

I wouldnt of noticed this but i was curious why the MBP was so quiet two minutes after starting an encode. The fan slowly over a couple more minutes went up to 5000rpm where the cpu settled at 90C a 5000RPM.

With tiger once my cpu hit 85C the computer would kick up the fans, but 105c! This is a day 1 SR MBP so i'm not sure if it's a documented issue. I also don't want to use SMCFanControl because i've been told that if apple sees it on the hdd they'll blame that and void my warranty.

Should I be concerned? Won't the MBP turn itself off to save itself from overheating?

if apple missed the boat the 105C issue, i bet they forgot about the overheating turn-off mechanism too.

The 'overheating turn-off mechanism' that you refer to is NOT something Apple has to 'turn on'. This is built into EVERY intel CPU and the CPU will first throttle then shutdown before catastrophic failure.
 
You don not void your warranty by installing SMC.
105c is crazy though. Can you replicate it more than 2-3 times by using handbrake? Try installing SMC and make it run fans on max and see your temps. If you can replicate it, take it to an apple store, startup handbrake and show them the temps. You might want to bring some bacon and some eggs just to prove your point. :)
