The problem people are having is that no one should be able to take control over your phone and force a restore so you lose your jailbreak for good.I have two of his tweaks and I paid for them long ago. Don't see a problem in his response.

You take your chances with cracked/pirated software, so no crying about it when it turns south on you.
It used to be that you took responsibility in your own hands when you jailbroke. Lately it seems people want no part of that but are more than willing to cheat devs. It's no wonder so many devs have abandoned jailbreak tweak development.

So, he's already in violation. What was stopping Apple from banning him before?

There's also the fact that 12.1.1 beta 3 is still being signed so his threat is pretty empty at the moment. Sure, you'd have to start over with the jailbreak but I'm pretty sure there's at least one tweak backup solution available for this jailbreak that would negate that issue.
Edit: Unless the signing window has closed and I missed it, of course.
