no, you need the passcode if you are using a different computer than the one you set it up with to even restore it

Only using DFU mode can they use your iPhone. That of coarse will erase all data on the iPhone. Otherwise, iTunes doesn't play nice with an iPhone that is passcode locked until you enter the passcode.
