Okay so I recently lost/got it stolen my iphone 3g. I don't really want to pay $400 for a new so here's what i'm thinking:

1. One of my friends, who has att service, is willing to buy an iphone under their contract so I can get it at a discounted $200 price (they don't have/want an iphone and eligible for upgrade).

Will there be any problems with doing this?

2. if there is a problem, maybe i'll pick up a used iphone 2g.

If i do get the 2g, will the data plan be $20/month w/ 200 text messages?
 
There shouldn't be any problems with that; as far as AT&T is concerned, your friend can just tell them he didn't like the phone and decided to sell/give it to you.
 
What I gather is your friend is going to purchase a phone and service so you have an iphone..
you may want to have your friend check their obligation to ATT in regards to the contractual and financial agreements.
