I can't find any max bitrate spec on the AppleTV infopage. But I remember ATV1 was max 5000kbps at 1280x720 at 23.97 fps. What I wonder is what max bitrate can I use for a 1280x720 at 25 fps movie? And if the 25 fps movie is 1280 width, but less than 720 height? I use mkvtools to convert, and I prefer the output to be ATV1 compatible.
 
Bear in mind that it could also depend on what codec profile the h264 stream is utilising (eg more complex profile could equal lower max bitrate), assuming there's no soft limit.
 
I've got some 1280x720 24fps High Profile Level 3.1 encodes that are upwards of 7000kbps that play perfectly fine on my ATV1. I once read, but can no longer find the source, that the opening movie that the ATV1 plays on boot up peaks at about 10000kbps and that plays fine, so I would take the apple specs with a pinch of salt.

My large 7000kbps encodes were created way back when I didn't really know what I was doing, and to be honest they gain nothing for it. My current 720p encodes come out at about 3500-4500kbps and look fanastic, so don't encode at a high bitrate just for the hell of it, when a lower bitrate will look just as good and take up a lot less space.
