Interesting...the folks who lost the phone, had to fairly web site savy to figure out where they were posted and then conclude that indeed McDonald's employees did the distribution. There are literally 100s of web sites, the have "wives" on them.

I think there is a lot more to this story than meets the eye. (pun intended)

The photos were not posted as anonymous photos at all. They also posted her name and address, and telephone number along with the photos. The couple ended up having to move because of this. McDonald's employees were responsible for doing this: "He says staff promised to secure the phone until he could retrieve it" That is why they are suing McDonald's.
 
If one of the customers picked it up, ransacked it and turned it in ... might not be McD's fault.

Though if the employees got it, put it in the office, and the peons played with it. it is almost a tough luck that they didn't password protect it.

And there isn't too much point in putting customer leavings in the safe either. The management was being nice if they even bothered to look for it.

Though I do know customers tend to sue at the drop of a hat, I saw slip and fall lawsuits, broken teeth on filet-o-fish and cherry pies, and an odd one from a lady who broke her pearl necklace in the playland suing for the necklace.

Did like the idiots who always got mad in drive thru and would run their car into the concrete filled pipes in revenge.

Ah yes. I hadn't read that version of the story. Just an earlier one with less facts. Well this certainly makes sense, the employees not only distributed them but with the intent to have her contacted etc.
 
I am all for sticking it to companies like McDonald's, but really. The only person truly at fault is the husband. Of course this type of thing would happen when a bunch of teenage boys are working.

People just want easy money.

But there are 16-18 year old males running around with access to a likely non-password protected phone with porn on it.

What else did they think would happen, if they left a notebook, the kids would play with it also if they had easy access to it in the office.

If you don't pick it up immediately ... you are leaving in the hand of kids.

The phone was safe from theft, but not from the kids.

Being nice to your customers by, for instance, looking for things they left goes a long way. I left my scarf in my local pub the other week and the landlady specifically came up to me and gave it back the next time I was in. It's things like that make me want to go back there and not somewhere else.

It's not like they left it on purpose and it's certainly not the phones owners who are at fault. If you find somebody's personal belongings you should have respect for it. Whether you are 18 or 80. What's on somebody's phone, especially pictures of family (naked or not) is personal to them. How would the employees like it if someone did the same to them?

However, I don't believe it is particularly McDonalds fault, although ultimately they will have to take responsibility. I am sure most people working at McDonalds would have done the right thing too.
 
I don't think it's the restaurant's fault, but who knows what the law says. Sometimes, the law differs from what I feel is right and wrong.

But Sun Baked is right. It's not a part of the service, and it's not mandatory or something the restaurant is legally responsible for doing. Whether you like things like this doesn't matter. The fact is that the restaurant was being nice about it if they had agreed to hold onto it at all.
 
They should have used discretion, and never sent them to a phone. *Shakes head at people*

I don't know its personal property and its not like they were being indiscreet with it...as in flashing red lights " my wife is nekkid on my phone". You know that many, many couples do this sort of thing. ;)

...but as other posters have pointed out, if you are going to have such sensitive stuff on a computer or a phone you had better protect it with a password at least.

You're taking the guy's description of the situation. The people at McD's might have said "IF we find it, we will put it up for safekeeping". Maybe someone else picked it up before McD's management did. I mean really, if the phone was sitting out for more than 5 minutes, someone else probably picked it up. I highly doubt the husband called the McDonalds within a few minutes of leaving the restaurant.

I call BS on this one...as I do for about 95% of "damaging" lawsuits being brought these days.

Chances are high, they found it, searched it for ID, and ran across the pics. Some immature person there saw the pics and thought it funny to put them on the internet. I hope they fire the person. And maybe one day they will grow up.
