No. No one wins at the game of patents and courts, except for the lawyers. And you know who loses the most ? The consumer.
This applies to all these players (Apple, Motorola, Samsung, Kodak, Nokia, RIM, Microsoft, etc...).

After losing the patent lawsuit filed by Motorola late last year, Apple withdrew some of hardware from their own webstore. Currently this only affects the german store, but the patent in question is European.

Not as simple as this. iPhone 4S and iPad 2 use Qualcomm chips that aren't part of this lawsuit so they're still for sale.

This could backfire on motorola in a major way. They've had these products banned on the basis of a FRAND patent. Those patents are covered by special rules, and they're supposed to license them fairly to anyone who needs them - if they didn't do that, the 3G networks wouldn't work, patent trolls would continuously pop up and demand money if you want to use your phone.
