They're in mp4 format, they can be played in iTunes, I have the movie checked when I'm syncing the phone, yet it won't show up on the phone nor sync. This is the same problem with iTunes 8 and 9 that I just downloaded today. What could be the problem?
 
Use the option under the Advanced menu to create an iPod or iPhone version, then try syncing the converted file(s).
 
What program did you use to encode them? Are they <=1500kbps H.264 with <=160kbps AAC audio?

If yes, there are still some advanced H.264 encoding options that are not compatible with the iPod Touch or iPhone. Notably (going off of Handbrake features here)...
