I think the phone is defective. He is like Well it's Loud in the store of course the speaker is low. So he goes to the back and tests the speaker after like 10mins he comes back saying yea.. ur speakers are fine. I'm like No they're not i can barely hear ppl when they talk to me when i use the speaker and when i'm in the car or at home... he is like well it's fine. i'm like ok wutever. Then i tell him bout my battery issue i have with the 5hrs of listenin to ipod. and OMG u wont believe wut he says. He is like will this is a phone not an ipod u treat it as a fone if u want ipod go buy an ipod. of course the ipod is not gonna last 24hrs. I was soo freaking pissed! So i'm like u know wut F*K this i want my money back. they're like well ur iphone is already been open there is a 10% stocking fee. I was like ok so let me get this straight... my Iphone is defective.. you won't replace it now that i wanna return your charging me stockin fee. and i was really pissed i started yelling they got the manager and said ok we'll wavie the fee. Call and ask for the manager .... explain what happened. Then go down there, and ask for that manager and tell him you want someone else to look at it and show you both the results. Maybe show the manager how low it is.

I wouldn't take that treatment from any store let along an Apple store.

5 hours battery does seem short, but it also depends what else is going on. Obviously if you're flipping through coverflow and browsing the web while listening, it will be well short of 24 hours. I assume 24 hours is everything turned off and just letting it shuffle or something.

Treat others how you want to be treated. :) Even in retail... Good luck with the new one. 5 hours does seem low, but like others said all radios must be off and screen barely used.

Something tells me the one you get tomorrow will have the exact same "problems" as the one you just returned... Good luck trying to explain to the store manager that you got two defective iPhones, especially if your speech follows your spelling :)

Less drama imo. Your not going to be getting 24 hours of ipod time if you have the LCD on. Period. If that LCD is on and its checking e-mail, your surfing through the cover flow etc.. it will last several hours at best. Pick an album. Play it with it in sleep mode. When its over jump to the next album or playlist. Surf the album using the button on the provided headphones. Problem solved.

Try less raving like a madman in an Apple store and perhaps you will be met with a more positive attitude from the Apple guys there. If I was that Apple employee I would have picked you up and thrown you out in the street. Lucky I dont work in retail :D

Your post makes you sound 12 years old.

FWIW, here is what Engadget got from their battery-life tests:

Playing relatively high bitrate VGA H.264 videos, our iPhone lasted almost exactly 9 freaking hours of continuous playback with cell and WiFi on (but Bluetooth off). Yeah, we had to pick our jaws up off the floor, too. So by our tests, you could watch a two hour movie and drain off a little more than 22% of the battery -- totally acceptable for trip-taking and the like.

Our music testing showed similarly outstanding results. Playing back 160-192Kbps MP3s, our iPhone pushed about 29 hours and 30 minutes music playback. To put that in perspective, the Apple claims the iPod nano gets about 24 hours playback on a full charge, and the iPod a scant 14 - 20 hours.

Get out of my store!

I think I would put this in the "user error" column. I feel sorry for those poor employee's at the Apple Store who have to put up with people like this. If I had my way, I would tell him to get the funk out of my store. It's too bad that people who have money, feel the need to complain to the underpaid and powerless about the most petty of issues. Honestly, if electronic goods are causing you so much angst, it may be time to stop using them.

The less calm you are the less service you will get. Be careful. They may black list you if you are to irate. When you get the new phone and notice issues with it, just remember to stay calm. When you started yelling and getting all mad the manager waived the fee because you were out of control and he needed you out of the store, now I was not there so I am going off what you said. I don't know about you, but if someone was going to give me what I wanted just to get me away from them I would feel like a total douche.

Calm the **** down, and please type more coherently. I can't believe I just wasted time trying to comprehend your post.

For what it's worth, I don't have much faith in many of the geniuses at the Apple Stores in Los Angeles, but there wasn't much reason to be acting the way you were. They have security for a reason, and probably won't hesitate to ask you to leave the store if you were acting like this in-store.

I suspect the second one will act just the same...so don't bother getting it or deal with it.

You know what, I walked into my Apple store (Jacksonville) yesterday because my earipiece speaker was resonating alot when at the top three highest volume settings, and when the Genius checked it out it seemed fine. I politely told him that it happens when I talk to people who speak louder than normal or have phones with higher volumes. He then said well maybe it was the connection echoing, and then I politely said, actually its happened the 3 times that Ive called my mom and two times that Ive called another friend of mine. He said ok, went to the back and brought out a brand new 8 gigger. Just like that. Being patient and polite will get you things alot easier. While I was waiting at the Genius bar for my appt there was a girl, about 25ish that still hadnt gotten her iPhone activated (had since friday) and she was yelling, cursing and throwing her iPhone around and the other Genius got pissed and was being really stern and loud and was like "Look ma'am, I cannot have you acting like this OK!? If you want me to help you then you need to be patient OK! Please DO NOT treat the iPhone like that because if you do then youll just damage it!!" I was amazed at the way she was acting, he could have really denied her service at that point because she was just acting horrible and possibly making other customers uncomfortable.

This is not a good fit for you. Buy a Helio Ocean. Did you know it has MySpace Mobile? That's pretty great, MySpace. You can comment your friends from anywhere! Is your top 8 not top 8-ish enough? By all mean change it, sir--right in the middle of dinner with your BOOOOOORRRING parents. And you'll have a GPS--so if you forget where you are, your phone will tell you.

Spend the extra $300 you save any way you wish. You will be happier.

Wow, why did i waste my time even trying to comprehend this post...? To those who might venture to this thread next. The moral of this story is don't let rich little kids have iPhones. Like someone else said, your lucky i wasn't an employee at said store or you would have bigger problems than your "broken" iPhone.

Look in the battery issues thread; you're not alone

Hey, battery issues are happening to a lot of people. Not just at Mac Rumors but on the Apple discussion boards as well. I mean tons.

I had similar issues with the Apple store in San Francisco, when I discovered that the track pad on my brand new iBook wasn't working properly. They kept trying to feed me the line that "hand lotion on my fingers" was the cause.

Since I'd previously owned 2 powerbooks before I bought the iBook, I wasn't buying. As it turns out there really was a defective track pad for that model.

I sincerely hope that Apple employees aren't trolling these boards, trying to discourage people who are having serious issues with their iPhones from getting satisfaction. That would be sad, indeed.
