i always wondered why nobody performed this test. i was using win xp via bootcamp for these last 2 days and not even once i got screen flicker. however in osx i have screen flick twice or 3 times a day. yes i do have all last soft/firmware updates in oxs. having this, can this still be an hardware issue?

I would tell Apple - interesting.

I'm sure Apple knows (at least I HOPE they do). If they are putting these machines out there without such simple testing, they are hosed in the long run. I full believe they knew of all the problems before they started shipping them out. There is just no way they didn't...

You have a valid point, however I can also see another explanation: Windows 7 uses hardware resources in a different way than OSX (for example not relaying on GPU in the same way) so something doesn't overheat, or doesn't have to perform some overstressing operations, and because of that it doesn't have to shut down once in a while. In this case it still would be a hardware issue (and not an easy one to fix)
