If not you are probably out of luck, think it says there is no warranty if jailbroken.
There is always private stores that can fix the phone so its able to boot.
There was also a rumor that the ones that are jailbroken leave a small trace that developers can find. But many lack the knowledge of seeing this.

I don't know about Flash memory but on a HDD it's fairly easy to find "Old" deleted stuff, unless written over multiple times.
So, they might find something but I think they won't even search for it, too much time involved.

The iPhone is encrypted and when you do a wipe, the key is destroyed and a new one generated. Without the old key, you won't be getting the old data even if it hasn't been overwritten.
ofcourse they can, who do you think has the key for the encryption?
It's a question if they will go that far.
