Hey, Im thinking of going back to apple tomorrow to see if they will exchange my phone. My first problem is that the back and sides of the silver "not chrome". got scratched somehow and i never dropped it or put it on a rough surface. And my second problem is that the speaker volume is VERY LOW. I am already on my 2nd one cuz the 1st on ppl said they couldnt hear me. So do i just be honest and tell them that the scratches are 1 problem, or just mention the speaker problem? will they send it out, or give me a new one?

You tell them both problems. Doesnt mean that there gunna listen to you or do anything about it, but why wouldnt you mention both problems if you have them? Just give it a try, it cant hurt.
 
Don't sweat the scratches. Honestly.

Complain about the volume. Complain loud. I'm not one for being picky at all, but I'm sick of rolling up the car windows to hear people on the phone, having to mute the tv, or go into the other room, and then to be told this is 'normal' volume for the iPhone... damn, I just missed another text.

Talking about the scratches might make them think that's why you're returning it, and that's not a warrantable issue. Stick to complaining about the volume. Besides, it'll scratch up later. The sooner you don't worry about scratches, the more you'll enjoy using it. I've actually been pretty loose with mine trying to get it scratched up, and it's pretty tough. Mine even went flying down the sidewalk like in the PC Mag video online... no scratches.
