I want to buy a new 3GS since apple are no longer requiring you to have a att contract but i have some question before doing it:
1. Are all the new iphone comes in 3.1.3?
2. If so, can they be jailbroken and unlocked?

Its a gamble, you cant be sure what firmware you're going to get in the box but good chances are the longer you take the less 3.1.2 3GS will be available.
Current 3GS models with 3.1.3 CANNOT be JB or unlocked.

are they working on that? does anyone know when will it be available? and i'm seeing some way to jailbreak and unlock 3.1.3, won't those help? or are the new phone has some new security firmware in it?

How about you trade me a new spanking 3gs for my gently used iphone 3g with 3.0 firmware, which can easily be unlocked

Noone knows for sure.
Good chances are a JB will be out when the next major firmware is released. Hackers dont want to reveal/blow their exploits on a worthless firmware update like 3.1.3
Not sure on the Unlock, some small steps have been made on the latest baseband but it could take a while or not even work out as planned. Still very early to tell.
