One thing you can say about BB is that they haven't ever seemingly stepped on Apple's patents.

In fact with the new QNX and upcoming BB10 (which an ideal time for release would be this late fall, not next winter), perhaps this might be the reprieve that BB needs to get it's toe hold back in the market.

At the very least if they can't afford to deliver the device AND software, then now the OS they are offering might look more appealing for someone to purchase/lease.

I have been fervently hoping for BB to get back up from all of the heavy hits and get back in the fight (skeptical now but I am still optimistic). BB10 based on their presentation a while back looked smooth as hell and really slick.

Might be an option if Apple gobbles up Android since they own the world of smart phones patents now. (Maybe Google/Moto can give them a swift kick in the nuts for us people who enjoy variety in a device).

Whatchoo think?

I don't think rulings FOR Apple will help RIM much. Android is still having a hard time getting into business environments due to security concerns, where Apple is getting A LOT of converts from BB's to iPhones. I work for a large corporation, most of the executives have made the jump to iPhone and have added iPads to their arsenal as well.

As an Android guy, I DO fear that yesterday's ruling will open the door for legal action against other Android OEMs. What concerns me about the ruling is that there are only so many shapes a phone can take, they're certainly not going to design a phone in the shape of a star, are they? Of course, I don't know EXACTLY what Apple's complaint about the Samsung designs was, but there were certainly "rectangular phones with rounded corners and touchscreen interface" before the iPhone. One thing to note is that Samsung uses an overlay (like HTC's Sense UI), I think much of the software concerns were related to their UI design, which has little to do with the underlying OS.

My civilian job issues both iPhones and Blackberry's; that's probably the case for many companies.

There is still an ample market for BB10 to go into, but increasingly, people that have a choice are dumping BB for iPhone, and BB needs to intro a product that makes people enjoy and want to use their BB more.

Samsung's verdict cant help or hurt that.

I don't think this holds up in an Appeal. The whole trial was a farce. You had a jury that was made up of average joes making a judgement on issues that were beyond the scope of their knowledge. There was also evidence that was not allowed that would have helped Samsung's case. And the whole rectangles with rounded corners will be thrown out. Just the very fact that there are numerous other phones on the market with that shape shows how ridiculous this verdict is. Thank goodness we don't have electronics companies with Apple's greedy mentality making TV sets, or else we'd have a massive problem in the industry. Can you imagine all display companies suing for a rectangular TV set. WOW!

QNX is solid, from my experience with the BB Playbook. If they throw out a nice screen size of 4.3 and above loaded with QNX, they could come back strong especially with a competitive price. Will RIM make logical and/or timely decisions this time around? I would bet against it. I hope to be proven wrong.

I dont think it will help at all. This patent thing isnt going to stop phones from coming out. There were rectangular phones out before the iPhone came out and Windows imo will still make a run.
Myself, im not fan of BB phones and unless everybody else was ordered to stop making them...i have no interest in getting a BB and i dont think everybody else will be ordered to stop making rectagular phones.

Appeals will go on for a while and Google will nail Apple with the notifications patent. Its all BS and we are the ones that will suffer. This patent war is ridiculous.

Actually, the jury was made up of 2 engineers and I think 4 were in the Silicone Valley industry. This wasn't a dumb jury, by any stretch of the imagination. . The main problem with this jury, was that The foreman is a mechanical engineer that worked with lawyers for years on his own video compression software. You can guess where his bias laid and most indicated in post trial interviews that the entire jury listened to him. Additionally, all the jurors came from Palo Alto (Apple's home turf.) gee, I wonder why Apple sued in the 9th district of California? Samsung was doomed before the trial even started.

But, as with most 9th circuit district court rulings, this will likely be thrown back at Judge Koh. I anticipate a lot of very rich politicians will get involved before the final verdict is handed down in 5 to 10 years.

As for BB10. Last time I looked it was all still vaporware and broken promises. Dates keep getting pushed back. They may be bankrupt before the phone and os can even get released, and I have issues buying a mobile phone product from a company that may not be around after you buy the phone. But if they ever do release a phone, I will look into it and if I buy one, it would only be to play around with. My S3 would be my primary. Time will tell what happens with RIM, but I'm not expecting much at this point.

Yea but even they aren't enough to turn Around Apples stagnating market share with iPhone users switching to Android.

Very constructive! Thanks! At least other posters offered something intelligent.

How are Apple going to "gobble" up Android? Android is approaching half a billion activated devices, half a million apps in the store, hundreds of handsets from dozens of OEMs and it's backed by some of the worlds most powerful companies.

Oh, and it's global and opensource and currently accounts for 65% of global smartphone sales and its still growing massively.

It's way too late for Apple to do much about it at this point.

Blackberry is dead

Android is going to face continued pressure from Apple and Microsoft. Both companies are going to strangle the life out of Android through patent litigation and tighter integration with their desktop platforms.

Dont think so. Google will win their patent fight with the notifications that Apple copied but i hope they do put pressure on them. Choice is a good thing and compitition makes things better ....until one feels too much pressure and goes and complains and sues that they are being run over by Samsung but dont sue anybody else like LG, HTC and whoever else made a similar phone.

Oh thats right, LG had theirs come out first and Apples then looked almost identical to it. Hmmm........

I honestly dont care who started what, or who is copying who or who makes the most money. I want good products and we will suffer from this lawsuit BS.

You know how many different guitars there are that look just like a Fender Strat? A lot!..and you dont see Fender suing them and you dont see Gibson suing anybody who make look a like Les Pauls. There are many more examples you could list. Just get over it Apple and press on and make better products.

Hahah. Yet another habitual troll. As far as I know Apple hasn't sued Google yet over Android devices. If they did Apple would be counter sued over Apples breaches of Google/Motorola IP.

If Apple and Microsoft et al. continue their colluding it is only a matter of time before Apple gets done by regulators for Antitrust breaches.

Tighter integration with desktop platforms? People don't want more vendor lock-in. The beauty of Android is that you can get full and equal access to all Google services whether you're on Windows, Mac or Linux

Besides this it is only a matter of time before Apple gets done by regulators for Antitrust breaches.

Blackberry is only drowning because it doesn't do anything to keep afloat.

Once a nice interface like BB10 gets to the market, I daresay that a lot of Blackberry users will come back. Not all of them, but they will regain some of their numbers. All they wanted was a nice touch interface like iPhone and Android have. They wanted to be part of all the fun.

I don't often agree with nuckin down below (quote) but I fear unless someone takes Apple to task for patents that are questionable (not the ones that directly represent their own inventions) that what nucken said, is the next step.

Also, although very late to the modern phone party, apparently they are taking their time to do an excellent product, they know this is their absolute LAST chance and want to make their best showing. Maybe it might be enough?

I believe if MS and Apple attempt to do this a regulator will ream them for Antitrust breaches well before they get very far.

Either way, the US patent system is so broken it's not funny.

Crikey Paul Hogan you need to lay off the troll accusations. :D

I agree..eventually Apple and Microsoft teaming up for patent buys is going to arouse some suspicion.

The RIM problem is this. When RIM was hot they could sell their proprietary servers for push email and messenger services. That's where the money was but most of the IT admins that I knew wanted to rip the RIM servers out because they were yet another device to manage and they consumed a lot of corporate bandwidth.

RIM's failure means that the Enterprise no longer need had faith in RIM as a company of leading technology and the wise decision would be to just leverage Microsoft services.

I don't expect a come back for RIM. Everyone else now provides the Blackberry services that were popular 6 years ago.

You do know that 'pinch-to-zoom' is one of the patents that apple was using against samsung recently.

I'm assuming BB will have that feature.

Such a feature should not have been allowed to have a patent....

wow you're saying this as if you have something to gain....anyway isn't it the post-pc era?

Do we actually need a desktop today? (average users)

This is why I am impatiently waiting for android 5th iteration. I think they are going to make it more desktopy than windows or apple, making you phone a true computing device as oppose to try sell you a desktop, laptop, tablet and phone, each one having its purpose.

I don't expect RIM to make a significant come back either. The question is whether WP8 can fill the void in enterprise. It would be the obvious choice though.

It's ok....I know i've deserved a few times mate.

I have no problems with RIM making a comeback but man has Waterloo been out of sync lately. They're really going to have to claw their way back to stem the flow of Android and emergence of Win 8.

I gotta say though these are exciting times for mobile computing.
