proactive NEARBY missing?

I had it working in Canada, but as of today it's missing. I was wondering if it was removed for us once again or if its just me?

It appeared for us in the UK for a week or so and it's gone again.

Since this proactive thing is more or less useless for now and News isn't even available everywhere (beside being crap) I wish Apple would give use the option to disable the left Spotlight pane.
