I've received my SR MBP from the Apple Online Store in mid August, I got in an Apple Store about a month later about the famous yellowing, they replaced the screen two times (the first time they just called me to inform that the screen was also a defect one and they ordered a new one) and finally the screen was still a Samsung yellow (who also had some physical problem) so I asked for a replacement. They inform me that since I didn't bought the MBP at this Apple Store they couldn't give me one that they had but they could order one from AppleCare for me, just that it could take 4 weeks.

So my question is : Is an Applecare replacement for a yellowish Macbook Pro is a NEW Macbook Pro or a REFURB ?

Also, if it is a NEW one, 4 weeks it is AppleCare normal time or it is only due to the 7-10business day that took a Macbook Pro 15'' to be shipped from the Online Store ? Because the 15'' MBP just got to a 1-2business day in the online Apple Store, is there a chance I receive it faster then ?

On the "Genius Bar Work Authorization" it is written that the "proposed resolution" is CRU.

It often depends on the situation, and with what is on hand. If there are refurbs they can send out, then you're likely going to get a refurb. If not, then you'll get a new one.

Apparently, MacBook Pros, for all the trouble they appear to be, are hard to come by. So the chances might be a good that you'll get a new one. On the other hand, most people give Apple high marks for their refurbished products, so it might not be such a bad thing to end up with a refurb. If anything, a refurb has probably gone through more testing then a new model, in order to recertify it.

Thanks!

Also, when I think of it, my Macbook Pro as a FrenchCanadian Keyboard layout, I think it must improve the chance of getting a new one.

Anyway, not that I will care if I receive a good working refurb, it's more about the 4 weeks delay without my precious computer. I'm just desperatly hoping the new short delay on Macbook Pro will help me getting my computer faster.

I totally understand the delay problem. I sort of wish Apple had a "loaner" program for MBPs similar to what they have with the iPhones that need repair. Even a basic Macbook as a loanr would hopefully ease the sting a bit.

However, the iPhone is understandable because you pay a monthly fee for a service.

my replacement took about 10 days (total) to arrive. it shipped sooner than my original one. it was also new (i think, how can i tell if it's not??). either way, the replacement also had the yellowing. I held onto it for a couple weeks but i am sending it back tomorrow.

If you get the "right" apple employee to work with you, you can basically hold onto your current unit while you're awaiting the arrival of the new MBP. Basically they take your charge card info, and if you don't return within X number of days after you receive your replacement, you'll be charged for the replacement MBP.
