Question about selling iPhone - re: contract

I recently upgraded to iPhone 4 and have my 3GS on eBay right now. I got a question from a potential buyer asking whether it is "under contract". I've never done this before, so I wasn't sure how to answer.

If I signed a new contract when I upgrade to iPhone 4, and my current SIM is in that phone, I would imagine the 3GS isn't under contract anymore. Is that right?

Yes, if you just upgraded to an iPhone4, the 3GS is not under any contract. Take out the old SIM card before you ship him the 3GS though.
