I'm planning on getting the new apple tv, and want to be able to stream my movies from my macbook pro. Will I be able to stream them when the mac is in sleep mode (lid closed) or does it have to be awake?

It does have to be awake, as only the RAM is powered during sleep and the movies are stored on the HDD, which needs to be spinning to be able to play movies stored on it.

Hmm, ok, what if i select the 'wake on network access' option in system preferences?

It SHOULD wake it up and stream whatever was requested from the ATV, however I find wake on network access to be flaky at best. Give it a try and google around, see what you can find :)
