im going to be as straight forward as possible, if i buy an iphone 3g on craigslist, and it happens to still have the apple warranty, can i take it back to apple and get a new one or at least a better iphone because one doesn't know what the previous owner did to the iphone they are selling...

Do you have any proof of the warranty?
Might be easier to ask them to provide proof of purchase

Apple Care is registered to the devices, so the Apple store would know, as far as knowing if the person you bought it off of is honest, definitely get proof of purchase.

Will the Apple store swap your phone if Apple Care applies? Maybe, depends on what you tell them is wrong with it... you can try the "My phone keeps powering it self off and on at random"

Of course if they find water damage or whatnot to the phone then all bets are off and you're screwed both ways.
 
might help you, i bought a refurb iphone from ATT just a couple of months ago...my camera died, so i had to take a trip to the apple store.

When they looked up my phone, they saw it was under another name. I told them that i bought the phone from ATT Refurb site and he changed it to my name...didnt really matter at that point though, since it was replaced with another phone. However, now this is in my name for the warranty.

They didnt ask for any proof of purchase or anything like that at all. They look up the serial number and check for water damage and that was pretty much it...of course in my situation we verified that the camera was broken.

They don't replace with new iPhones, they replaced the defective ones with refurbished iPhones.

correct....they say they replace the back on it...

I wish it was new =( , however, i dont mind, i bought a refurbed to begin with for 50$.
