I have had my apple tv2 since October. However I have recently signed up to lovefilm and am streaming all my content through my ps3 now so no longer need my apple tv2.

Can I still return it from October? If not can I get a gift voucher for it? If not what would the do if I said it was faulty like switching off on it's own etc?

If it is not faulty then it is very dishonest and technically fraud to say it is just to get rid of it. Not Apple's fault that you have changed your mind/no longer need.
Put it on ebay, it will sell. Or go in and be honest about the situation,may well get you somewhere
