ok so here is the story, somehow Rogers managed to link my two brothers accounts together. The one Brother had been paying his contract while the other had not, upon reaching the allowed limit of not being payed both iphones (one 3G contract not paid) (one 3GS contract was continualy paid for ontime) were denied service.

so after they called Rogers and sorted out the accounts Brother x (hadnt been paying) was allowed service while Brother Y is still locked out of service.

thats the story, now my question.

My brother's idea is that after 2 weeks if Rogers has not provided service for a phone where the contract has been paid for on time and continualy, then that is a breach of contract on their part. so with that in mind his idea is that he will (upon two weeks of no service) will leave rogers pay no ETF and recieve a factory unlock.

is this at all plausible? I'm inclined to think not, but i thought i'd ask.

both accounts are obviously with Rogers.
 
Sounds feasible to me.

If the brother who has made all payments on time and is being denied service is able to provide proof that he has made those payments, there's no way Rogers can deny him either being reimbursed for the time without service or leaving with no early termination penalty.
 
i dont think Rogers will "pay" the ETF fee cause thats if you want to cancel it

and isnt there a IMEI number or something and if Rogers bans that number the phone is locked and wont be able to be used?

but is it not a breach of contract on their part? he has paid the bills on time andyet they deny him wireless phone service.
 
You better have the two separate account numbers and make sure they where never set up under the same BAN. cause if they are and you call bluff thy have the right to bill you. Either way it WILL screw up both of their credit ratings (bros). This will also affect you going to Bell/Telus and you'll enjoy another hit on both their credit ratings. Think this through before cancelling and make sure you specifically state that you want all credit bureaus Rogers reports to has this entry cleared as in error! Repeat it as many times to get accepted and clearly understood. Get the name location of the rep and their manager and record the time. Then send an email to their manager@rci.Rogers.com
