Isn't Apple the only company producing smartphones allowed to use LiquidMetal tech ?

Yes...

Reportedly the Apple license gives them perpetual exclusive consumer electronics rights to any technology created or acquired by Liquidmetal up to at least February 2014.

Anything invented by the scientists at Liquidmetal after that is fair game to license to others, unless Apple manages to extend their coverage again.

Maybe HTC needs to worry about making phones with software glitches or outdated software before worrying about liquid metal tech.

htc is the making great phones, they're using the best materials to make their phones beautiful. but, i will say that htc also needs to focus on sense, sense lags, it doesn't have many features, it's complex, etc. while making better hardware they should also focus on the software.

htc is already in a bad position (employees are leaving it, nokia is also at war with htc) i don't think htc should attract more lawsuits.
