Just downloaded the last upgrade to 10.3.9. which automatically upgrades safari to 1.3 . Why would they remove the ability to save downloads on the fly to a folder of my choice or did I miss something ? Work around other than going to preferences ?. Will be upgrading computors later this year . Is this how Safari 2 behaves ?

Safari 2 does it too, you can choose in Safari's preferences a default location though.
