Hello guys,

I've missed the timeframe for buying a new iPhone 5 which I can definitely jailbreak.

So, if I'm going to buy one now, is there a way to see which iOS is preinstalled?

AND

Am I able to stay with the preinstalled iOS or do I have to upgrade once I've booted the device?

You are fine. The only way to update is in the settings or in itunes.

Now I need to know which iOS is preinstalled. I want to have at least 6.1.

Production week: 7 (February)

How do I find out which iOS it has?

/edit: iOS 6.1 release was at 28. January...
 
The only way you can see the current version is through settings:

Settings > General > About > Version

The Evasi0n jailbreak is compatible with iOS:

The iPhone 5 comes pre-installed with iOS 6.0.1 or 6.1.

Okay, since you know it comes preinstalled with 6.1 - do have any knowledge regarding the date is was build?
 
What that build date it is probably 6.1 but not 6.1.3.
So that one will be jailbreakable and you can stay on 6.1
 
Hire a prognosticator to accompany you to the store or just return the phone during the return period if it can't be jailbroken.
