Ok so I had the first iPhone then the 3g and now the 3gs . The battery on my 3gs is horrible. I took it off charge at 8am and it's now 1:30 pm and I'm at 12 percent. I been textig a bit and on the web and facebook but I know that can't be normal. My 3g was pretty good on battery and no where near as bad as this is.
Should I try and bring it back for a new/refurb one?

Sadly I was having the same if not worse issue with my 3G. I was getting 2 hours of usage and 5 hours of standby before I had to recharge my battery. Fed up I took it to the Genius Bar and the tech told me that on average my battery lasts about 4 1/2 hours which he said was great. I explained to him that the application he was using was b.s. I've had my phone since January and I had great battery life. I told him if I charged my phone after 10 hours of usage 100 times and the last 35+ times I've been getting extremely poor battery life that would explain the average time as 4 1/2 hours therefore the program bs. The Genius Tech told me to come back if I have any more issues.
I have push turned off.
Bluetooth off.
Location services off.
Brightness all the way down.
4-5 bars of 3G.
 
Haven’t bothered yet. I leave it charging on my desk at work now. I also have numerous scratches and dust under my screen. It doesn’t bother me enough to waste an evening at a tech bench. Maybe before my 1 year warranty runs out I'll bother.
 
I dunno - 4 hours of 3G data usage - it could be right/within normality.

Did you calibrate the battery?

Calibrating the battery does not increase battery life.

I would try turning off Push/Notifications, see if you can get more usage time. 4 hours is quite normal and I think Apple will tell you nothing is wrong.

no - it doesn't increase battery life - but it does accurately indicate where your battery is. His iPhone could say he's down to 12 percent and it could actually be 30 percent.
 
Yes I did more than once and it didn't help.

OP, one thing you shouldn't do is calibrate often. More than once a month is not recommended and can shorten battery life. Your battery seems like it is not upto the standards I would expect for a 3GS, since it is worse than what I'm getting for a 3G. I would think you should take it back to the store and have it diagnosed by a Genius.
