I just jail broke my iPhone and I am trying to install the COD4 sound theme pack for sms messages and I use winterboard to "active" it and I go into settings and all my sms sounds are silent.. I can deactivate it in winterboard and it is fine any ideas?

Depends how old the theme is.
Apple changed SMS to Messages when 3.x came out.
Old SMS based themes no longer work if the developer hasn't updated them to Messages.
