The argument is that if you take Apple's position to its logical conclusion, Apple ought to also remove stock tracking apps and weather apps from the Apps store. Since they haven't, it's not unreasonable to infer that Apple is enforcing their position inconsistently. i.e., It considers some features more important than others.
Better examples though, I'd think, would be the various VoIP and free SMS apps. They are all alternate ways of using iPhone as a phone.
