I'm thinking about buying an iPhone 3GS, but reading the forums here, I'm not sure if I would be able to jailbreak one if I buy one new? Please advise, thanks.
 
Possibly.

The longer you wait, the greater the probability you will get a 3.1.3 phone. Get one from the ATT store as perhaps the stock isn't replenished as often as the apple store.
 
Thanks, the suggestion to visit an AT&T store rather than the Apple store does help a little. I was hoping that a person who recently bought a 3GS would be able to give a more definitive answer as to whether they got a 3.1.2 or a 3.1.3.
 
I just got one replaced at Apple Store today, 3.1.2, but don't wait too long, as it is only old stock that will have this firmware!

i just want to let you know that if you are lucky enough and got an iphone 3GS 3.1.2, you can jailbreak it but don't get any applications that require a reboot, otherwise you might get your iphone stook in to restore mode. The only thing that you would be able to do then will be upgrade to 3.1.3 and use it as an IPOD, or don't upgrade and wait months for a possible solution.

what are you talking about? you can restore to 3.1.2... just download the file manually (search google for it).

Can't you just downgrade in case it has 3.1.3?

you could, but the baseband will be upgraded which will make it impossible to unlock.

That's called a tethered jailbreak.
You should have done some research before you updated it to 3.1.3
 
Why not you wait till the next iPhone is released so that you can get the 3GS with OS 4.0?
