I heard that you can buy an iPhone in the US without AT&T subscription again like you could with the original iPhone, is that true?

I'm not a US citizen if that matters...

And yeah, do you have to jailbreak it to unlock it?

you have been able to do this all along`

3gs 16 GB $499 32 GB $599 but it's still licensed to AT&T , AT&T or Apple will not factory unlock so you must jb/un lock if you are in a area that you can buy factory unlocked I would do that! no jb/un for any firmware above 3.1.2 nobody knows when!

FWIW, until a few weeks ago, you still had to be an AT&T customer to buy at full-price. Although nothing with a contract was done, apple still verified that you were an AT&T customer before they could sell it you. Now anyone can buy them at full price.

At one point, there was a device could you buy that piggybacked on your SIM card that would fool an iPhone into thinking a non-AT&T SIM was AT&T, but I don't know if that still works. That was from a few years back...

Hopefully they release a 3.1.3 jailbreak soon!
