Is it fair that Apple can block my Core 2 Duo MacBook from 64-bit systems.

So today I had an Online Chat with apple support and Was asking A few questions here is How it went:

I have a few questions about my MacBook and OS X and Yes.

Apple:

So I got this macbook about a month ago from someone for online schooling and my family is on budget, and some thing reqire osx 10.8 and later is there any way I can get 10.8 or 10.9 unofficially even ?

Apple:
It looks like the model showing up here is the Macbook 13 inch from Late 2006. That model can only upgrade to OS X 10.7.5 due to hardware compatibility.

I would be disappointed if apple does not because my macbook is 64-bit architecture but apple blocks it out. it is A Core 2 Duo which your 2009-2012 MacBooks have. If it can run Windows 10 it sure can run El Capitan!

And is there any way to download mavericks or yosemite because I cannot find it anywhere on the appstore.

Apple
There is not, with the release of El Capitan any model that can support Mavericks or Yosemite can also support El Capitan so we pulled the previous versions to ensure everyone is up to date

So can anyone still help me with getting Mavericks and/or Yosemite installer? And flashing it on my Late-2006 13.3 inch MacBook Core 2 Duo Black A1181? Any help appreciated!!!!!!!

Yes I think it is fair for a company making software to determine which older platforms they intend to support for it, even if it is an arbitrary choice and not directly related to hardware.

I also think it is fair for people to try to run that software on the unsupported hardware anyway, with the understanding that they shouldn't expect the company to support them in any way.

Here is a guide for getting newer versions of OS X installed on unsupported (but otherwise compatible) hardware:
