We bought a 17" MBP about 2 weeks ago. Today was the last day to return it and the MBP got an upgrade. We called the retail store, was told we would have to pay the 10% restocking fee. With the new 4GB Nano deal we were still going to return and upgrade, but when we got there they didn't charge us the 10% fee (as long as we got a gift card). So we got a nice upgrade and free 4gb Nano!

I have a sort of similar story except mine is because the powerbook g4 i have has had major major problems 3 times and apple finally said we are sorry we can either try and repair it again or b/c no more powerbooks, we can give you a MBP. They covered the base price and I was able to pay upgrade to anything I wanted. They even went so far as allowing me to hold off on replacing the PB for a month because of the suspected update, now that is really cool of them. I love this company. they get it right about 98% of the time, but when they miss they really do try hard to make it right.
