the Dumbest Lawsuit against Apple yet?

Don't make promises you can't "deliver" on. Simple business rule. Do you think ATT is going to be kind to you with your 1 day late bill? If you get screwed by the corps, why not? It's not like they have a soul.

And it is misleading. I could see a Grandmother wanting to give her grandchild music as a gift. Only knowing that he/she has an iPod, she gets the child an iTunes gift card. She could potentially be thinking that the person is going to be able to get 25 songs. In reality, there will only be 20 gotten.

What happens when your cable company says you can get 100 channels and you only get 75? Wouldn't you be mad?
 
I saw this on AppleInsider last Thursday. It is pretty stupid, but I can see how people who were used to the .99 pricing could be upset when they think they can get 15 songs when really, they might only be able to get 11.

In the end, a gift card is a gift card, so whatever the amount is listed on it should be final.
 
yea... stupid... but its kinda true... i mean some people might be mad... i was mad when they made the songs be 1.27...

They bought 2 $25 gift cards in 2008 when the songs were in fact $0.99. The fact that the pricing changed over a year later doesn't mean anything.
They bought the second gift card in May 2009 AFTER the price increases... The gift card simply has a dollar amount on it. Does the little paper holder that comes with say that the songs are $0.99?? :confused:
 
Usually in the fine print there's something about price changes without notice.

That, and Apple (and Sony, and Dell, and Microsoft, and Creative, and etc etc) all say their PMPs hold n amount of songs when it depends entirely on the compression. Lawsuits like this really are ridiculous I think. If these sue-happy idiots had their way, we wouldn't be able to buy a single carrot without some long drawn out fine-print...

then that's a potential problem and Apple should fix that ASAP. However, as Melrose pointed out, there is likely fine print on there about prices subject to change without notice.

The fact of the matter is they bought a gift card for $25 and will be able to buy $25 worth of music and/or apps, videos, whatever. The only card they have even half a foot to stand on is the May 2009 purchase if the little wrapper thing still said that all songs were $0.99. For their March 2008 cards, IMO they are SOL.

It doesn't say that. What is says is this: “Songs are 99 cents and videos start at $1.99.”

That is false. If you bought a product that said one thing on the box and upon using it you were confronted with another thing, you'd be angry too.

How many people really know that it's an iTunes credit? There still are people out there who don't have large music libraries. They could have very well thought that they were buying $25 songs.

Also, clean up the language. Seriously, do you kiss ya mama w/ that mouth?
 
I wish you wouldn't complain about language its just words it can't really hurt you.

I notice that they are complaining that some songs cost $1.29, failing to be consoled by the 0.69 ones.

Cases like this are so petty, just an indication of the direction the modern world takes.
 
Too bad you cannot sue some of these people for their right to survive and be part of the human race.

You can. Actually, only the government (acting on all our authority) can do it. It's called death penalty. Typically, it's reserved for major crimes.

  • Would the plaintiffs sue if they purchased only 69 cent songs?
  • Does it make a difference that many of the 10+song albums with $1.29-each songs still cost 9.99?
  • They chose to purchase individual $1.29 songs and are complaining they don't cost 99 cents -- a year later!
 
This doesnt beat the lawsuit of the guy who sued Apple because the and the mafia tried to scare him into buying new apple equipment.
