Here's my story:

Last friday (6/2/06) I finally broke down and went to the apple store and bought a 15" MBP. When I got home it was quiet, no whine. The next day, I did the firmware update and installed windows. Of course after that .... the dreaded CPU whine. My current fix is to run QuietMBP, as MNK didn't work for me.

My MBP is a week 16 build. While I can live with running QuietMBP, I'm not entirely thrilled that I need to run something to make it quiet. After reading all of the stories around here and other blogs, it seems that sending it back doesn't seem to solve anything.

My predicament is that this is my only computer, as I sold my 12" PB to partially fund this one. (and I mean partially) My iBook at work crapped out, (busted display) so I only need to bring it to work for a couple more weeks (I teach).

I'm wondering now whether I should return it and ask for a one of a later build date (~week 20), or just deal and hope that Apple comes out with a fix for it in a future update.

What do you guys think?

If it is really a flaw in the computer, then they NEED to either fix it or replace the POS!.

It will be a major hassle to get a new unit from them.

The service people at apple are slow, tedious, and couldn't fix their way out of paper bag.

It took me nearly 6 months to finally get a replacement for a defective 12" PB.

I actually had to go as far as begin to file documents with the attorney general.

You paid big bucks for a working computer! And that's is exactly what you should receive.
I have and will buy more apple products but sometimes you need to play hard ball with the Apple service people.

I hope you've been on the phone with apple service documenting your problem.
Expect to spend many hours on the phone and get the run around with some very "sincere sounding" people.

If you depend on this computer but you want to write it off better get something to tide you over during the times you will be sending it back to apple.
I can assure you the process won't be fun! (6 months total hassle)
Or maybe you will be luckier than I.
All in all it was worth the hassle because I ended up with a good PB.

Just because you had a lousy experience (for which I am sorry), does not mean the rest of the world are getting the finger treatment from Apple.

If you bought it on the 2nd cant you just say hey I want a new one this one is having problems, or worst case scenario cant you return that one for full money back then just buy the same thing it should still be under warranty.

That's reassuring because during my ordeal I got the impression it was SOP!
Part of the hassle was because the defective unit was my first apple.
All in all still better than having a PC!
