I'm collecting evidence for a bug report. I'd really appreciate if you could follow these steps:
  1. In a Finder window, go to any folder which contains enough items for the window to be scrollable (your Downloads folder probably fits the bill).
  2. Using your thumb to click, grab any file and hold it down.
  3. Keeping your thumb down, scroll inside the Finder window using your index and middle finger.
  4. Respond to this post which behavior you encounter:
    A) The cursor holding the file stays still, and the content behind it scrolls.
    B) The cursor moves with your index and middle finger, and the content behind it does not scroll.
If you're super cool: comment your result and what device you're using.

Alternatively, you can open Photos and try to scroll while the cursor is holding a photo.

I get behavior A (which I believe is the correct behavior)

Tested on a MacBook Pro (13-inch, 2019) and a MacBook Pro (15-inch, 2017) both running macOS 12.1 Monterey.

Behavior A. (But sometimes trackpad reads 3 fingers moving depending on proximity or precision with fingers).
MacBook Pro M1 16GB/1TB
(But I have observed weird behavior in prior OS, 12.0.1, when sometimes in list view I couldn't even click&pick a file; it worked in other views. Fixed after restart)

Move the file a little from its place with your index finger alone, while the thumb is still pressed. Then you can try to start scrolling with your step (3).
