i found that my default DNS servers were causing this issue for me.
i temporarily changed DNS to OpenDNS and it updated instantly.

I went into the configuration page of my modem/router (to which the Apple TV is connected) and changed the DNS servers (both primary and secondary) to 8.8.8.8 (this is google's DNS server) instead of using the ones provided by my ISP. Rebooted the modem. At that point the Apple TV had no problem downloading and installing the update. When the procedure finished, I re-enabled the DNS servers from my ISP.
This saved me a micro USB cable.
