Unlocked, jailbroken iPhone - would i be in trouble if Apple etc. found out?

I have a unlocked, jailbroken iPhone 3G 3.1.2 - would i be in trouble if Apple or my phone company found out?

1) I cracked my screen and if i wanted to get a replacement from Apple, they would know that i have had it jailbroken.

2) Somehow all the credit from my pay-as-you-go sim disappeared, i wanted to go to Orange(phone company) to complain or find some answers why. They would know that I have had it unlocked. (not sure if it needed to be unlocked because Orange has iPhones now-where i am, but I was using my old sim card)

Would they be willing to help me even though my iPhone is unlocked and jailbroken?

(The thing is that i don't know if unlocking and jailbreaking your iPhone is legal or not?)

(Sorry if I'm getting this all wrong, I'm just a newbie at all of this stuff - it's so confusing!)

EDIT: I don't want to restore my lovely iPhone!! it took me hours to sort everything out - the apps, music, jailbreak.
oh well.. that's annoying to have to restore it.

1. Just restore the phone before you take it to apple. And put an active legit sim in the phone. When I take my phone in, I borrow my relative's AT&T sim.


2.The lost of credit only regards your account and it's balance, not the phone itself. They shouldn't even ask what kind of phone you have.

I have T-Mobile and they are way cool to my iPhone and I. They even have their tech support people trained to help with iPhone problems.

As far as this part, there are independent shops that will repair your iPhone for you in most major cities. Failing that you can send it away. The price from these places is half the price of returning it to Apple. These independent iPhone repair shops don't care about how you're using it or how you have it set up. If anything they might trade tips with you.

My understanding is that currently unlocking is legal and jailbreaking (other than to unlock) is illegal in the US according to the DMCA. But Apple has shown no interest in suing jailbreakers. They may deny you support if they determine your phone is jailbroken. But, as pointed out earlier, a restore before you bring it in should do the trick.

I don't really understand these threads. I have no real feelings one way or another about jailbreaking, but if you do it, shouldn't you be aware of what you're doing to your phone? Apple clearly does not support or repair jailbroken phones. If you do jailbreak and something happens to your phone as a result, deal with it, it's your fault and you knew the risks going in. Again, I don't have a problem with jailbreaking per se, I just have a problem with people knowingly damaging their devices and then acting like they were the one that was wronged when they won't get support for it. If I drop my phone and break it, it's the exact same thing; Apple doesn't owe me anything.
