Its not just you, i also have the issue with up to date. in fact, if you google, hundred of people have their claim denied by nonsense reason. I purchased an Apple certified refurbished MacBook Air on Dec 6th from Apple online store & picked it up from my local Apple Store on the 14th. I was told on that my refurbish MacBook Air is eligible for the free mountain lion up to date program as it comes with lion.
In fact, all the refurbished Mac are eligible for the up to date program as states one the apple website

So I submitted my claim with my order receipt that shows the order number, order date, product description & product ID along with serial number, then I got a denial latter as followed:

The person clear was retarded enough and cant read the receipt with order number, product description & part number on the receipt or can not understand English. Even when the receipt clear shows it is a qualifying product. But once I google search, I realized many many more people have the same situation where they are WRONGFULLY denied the claim with nonsense reason.

There are hundred more cases like this where claim denied for reason such as not from authorized apple seller (for purchase from apple online stored directly), not qualifying purchase (they consider a MacBook are not a qualifying purchase) to out of the 30 days limited ( when submitted within a week of purchase). Does anyone know where third world country is the up-to-date support outsourced to? India? China? And if Apple wrongfully denying people OSX up to date as they promised on the website, should that be consider illegal false advertising? Since they are promising an OS that they wont deliver after the purchase. And it does seems like there are hundred of cases out there. I was wonder if anyone have such issues can you state it here? Thanks.
