Upgrade from iPhone 2G to iPhone 3GS?

I want to pay the $199 price for the iPhone 3GS, but I am hearing that I cannot? Because I wanted to get it on the 29th (October) but...do I have to wait until my contract ends so I don't have to pay the $499 instead of $199?
