Upgrade HD MBP 08 uni (applecare issues? model/size advice?)

I am wanting to upgrade my internal HD on my Late Model 08 MBP but wasn't sure -

1. if it violated my applecare?
2. if I could find a 750gb or 1tb?

I appreciate any advice/suggestions on what models to look at? Maybe I can score something over this sales weekend...
