Hi all.

I recently designed some mocks for a champagne label to be used for a pitch by a client to a well known champagne brand.

So the pitch has happened and as far as i know all went well... so well in fact that the company are reasonably keen on using one of my designs as the label for the champagne.

At the time of designing i made sure that all i gave them were low res jpegs so that no 'idea stealing' could go on, in the hop e that they would infactlike my designs and ask to buy them.

This is now a real possibility but i really do not know how much to charge???

The new champagne line will be released in a limited territory to start and not worldwide, but there is the huge possibility of the brand going worldwide if it is successful in the sole territory that its released.

My questions lie with;

1. how much should i charge to sell the copyright/designs to the company for use in sole territory?

2. should i 'licence' the design for said territory and keep the copyright so if they decide to go worldwide i have to sell the design and copyrights in full to them at that point in time?

I hope i have been clear here, please ask questions if needed.

Please also note i haven't included any names or territories here in case somehow someone involved stumbles across this forum

A good brand/logo can go for some good $$$. You don't have quite as much bartering power after the fact but what's done is done. I would start high and let them know you're open for negotiations. As for a number, I don't know because I know nothing about the company, their budget, your work.... so it's very hard to guess on some of the important unknowns. Don't sell yourself short though.

Personally in your situation I would probably try (note: I always try to do this stuff in advance) to sort out some sort of yearly licensing deal which can be amended if they do expand on its use. It might also be more appealing being that we are in a recession but don't forget to be open for negotiations as said.

For a quick idea of what I mean.
Ignore the figures below its just for visual representation, as said the figures etc depend entirely on the company more than anything here.

So say for one territory you can charge £100 and then either have a set or predefined rate(s) (different sizes territories get different rates) per additional territory, maybe even consider a discount for a worldwide or additional teritories.

Don't forget to make sure the logo/branding can only be used on the predefined products, otherwise they could do slight alterations etc for other ones without paying.

I personally wouldn't be selling off the copyright without a healthy pay check.

Thanks so far for the advice, is there anywhere anyone could point me for help with wording a contract....

use exactly this: AIGA Standard form of Agreement for Design Services

every client we have signs one of these for every project, period.
