My son-in-law just upgraded to a 3gs, and is giving me his old 3g. Can I use this as a touch with wifi if I don't connect to att. I don't care about the phone aspect of it. Do I have to hack, jailbreak or anything else to use it and download apps from itunes? Rick

Yeah youre fine. He can use it without syncing / connecting to at&t. Just make sure its ALWAYS in airplane mode to save battery.
You can use it as a touch without doing anything to it. Just keep it in airplane mode and you are the proud owner of an iPod touchphone.
I've heard that you should keep the SIM card it was last activated with, in case you need to restore or upgrade firmware.
