A few days ago, I bought a case for iPhone 16 Pro Max. The box was sealed like any other apple product but the case inside was clearly used. It was kind of greasy and smelled like a cheap fragrance. I bought it at a reputable store.

I'd be curious which store you bought it from (you don't have to answer.) I am pretty confident that Apple does not permit its third-party sellers to repackage used items and sell them as "new." However, they can sell them as previously -owned or used, as long as it is noted as such. I'd report it to the store. Sorry this happened to you.
 
It is actually quite easy to open the box without ripping the seal and then seal it back up again. I suspect that is what's happened here and it's been returned as "unopened".
 
Could have been a return that wasn't inspected properly.
Another red flag 🚩.

Also when I go to the shops like Ross and TJX people leave empty boxes of Apple Watch straps, iPhone cases and everything else laying around.

I saw a few Guess and Kate spade cases that people just throw in the open box cases in there and put it back in the box like that, or their old filthy iPhone case they snuck in to get the one they wanted in their iPhones without even paying for it. They put the cases they saw in the store on their own iPhone.

Terrible service… that’s why I check for seals on the Apple boxes and also look inside to make sure the strap is inside.
