Can anyone advice on the legality of the following.

Would an app that essentially used the gps to locate the user on a map and then link to a website such as http://www.newyorkontap.com/subways.asp

a website to find bars on a map.

But linking to this website inside the app, not using safari to access it.

Basically its an app that enables location finding and adapts a site to the mobile screen but uses a third party website. Emphasis on the fact that i do not own or am not affiliated in any way with www.newyorkontap.com

anyone know if this would be ok or allowed?

It's a fairly complicated question... the practice essentially is the same as what is sometimes called "deep linking."

As you can see, the views vary quite a bit on whether this practice is considered acceptable or not. The best resource is the site in question's own use policy, but they don't always address issues like this.
