I received it for a very good deal with what I supposed was everything that it should come with... iPhone, Headphones, Charger/USB cables.

The problem is, that it did not come with any software or anything. What software/discs do I need to get it working? Do I just need to download iTunes and then connect the iphone? Any help would be very much appreciated!

Download the very very latest itunes.
Down 10.4.10

Restart (just to be sure)

Plug everything in and launch itunes.

it will start up.. not sure how the activation will go...

OK Cool! Thanks guys! I have one more question however. How do I go about registering/activating the iPhone? The person I bought it from has it in his name. Will I still be able to hook it up and use it like it's new?

Im pretty sure yeah, when your hooking it up to your computer and its setting it up it will give you a choice to use the old number or choose a new one..choose the new one and just set everything up :)

Thanks man! Will it work with my 64k smartchip sim card after I set it up?

Also, A few people have told me that; I should have not bought the phone becau it could have been stolen and if it was, it will just be an expensive brick. I am 99% sure that the person was legitimate, but if that was the case, would there be any way to use it? The same people has also said the they can track a stolen iPhone and arrest you for purchasing stolen goods, even if you change the sim card.

Is there any truth to these statements?

Umm all i know about that is it comes with a sim card in it already that you set up through itunes, it was really simple and i was surprised at how easy it is, you dont have to do it through an at&t store or over the phone with at&t or anything it sets it up right there through the itunes store, and if you want to use any other sim card you have to go through this long complicated and potentially dangerous process to switch them

Uh Oh.... It did not come with a sim card!!!! All I have is my card from my old phone! Can anyone help me thorough this process?

is there an at&t store near you? if so, just go there and ask for a new, blank sim card (they should give it to you for free) and insert it into the iphone and then connect it to your mac.
