We don't know, Apple hasn't said, it seem like turning off WiFi fixes it, so its likely software. I'm sure if you agrue enough Apple would probably give you a new computer should it not be able to be fixed via a patch. IMO if this can't be fixed with a software patch this would be at full recall status.
