What is this phone?

I took this photo in France around mid-July this year, and after reading rumours of the upcoming iPhone 5 and in particular the elongated "home" button, could this be a prototype? The photo is quite grainy (taken on my own 3GS) as I was trying to not be too obvious about the fact I was taking photos of this person's phone in close quarters.
