Good luck. I wouldn't advise returning it if it isn't the OS version you have though..

That is why I am trying to decide if I want to go to Best Buy and look at the back of the packaging before getting it.

I don't believe the back of the packaging displays the iOS version.

It depends when it was manufactured, as soon as the update is available they start shipping with the latest version to the best of my knowledge. If it’s been sitting in a stock room for a bit then it’ll be an older version.
